Terms of Service

Welcome to ORCHESTRATED ("we," "our," or "us"). By accessing or using our website, app, and services (the "Platform"), you agree to be bound by these Terms of Service.

1. Nature of the Service

ORCHESTRATED is an online classifieds platform designed to connect buyers and sellers of musical instruments. We do not broker deals, process payments for instruments, or handle shipping. All negotiations, transactions, and transfers of goods occur directly between the buyer and the seller off-platform.

2. User Accounts and Listings

To create a listing, you must register for an account. You agree to provide accurate, current, and complete information.

Listing Accuracy: Sellers are solely responsible for the accuracy of their listings, including the condition, authenticity, and legal ownership of the instrument.

Prohibited Items: You may not list counterfeit instruments, stolen goods, or items that infringe on intellectual property rights.

3. Fees and Payments

Listing Fees: ORCHESTRATED charges a one-time listing fee to publish an instrument on the Platform. (Note: During our launch phase, this fee may be waived).

No Commission: We do not take a percentage or commission of the final sale price.

Non-Refundable: Once a listing is published, the listing fee (if applicable) is non-refundable, regardless of whether the instrument sells.

4. User Conduct

Users agree to communicate respectfully. Harassment, spamming, or attempting to defraud other users will result in immediate account termination and permanent banning from the Platform.

5. Limitation of Liability and Assumption of Risk

Because we are not a party to the actual transaction between buyers and sellers, you use the Platform at your own risk. ORCHESTRATED, its founder Jennen Ngiau-Keng, and its affiliates are not responsible or liable for:

  • The condition, safety, or authenticity of any instrument listed.

  • Any financial loss, fraud, or scams perpetrated by users.

  • The failure of a buyer to pay or a seller to deliver an item.

  • Any damages occurring during the shipping or handover process.

We strongly encourage all users to exercise caution, use secure payment methods (such as PayPal Goods & Services or escrow services), and verify the identity of the person they are transacting with.

6. Governing Law

These Terms shall be governed by the laws of Victoria, Australia, without regard to its conflict of law provisions.
